Jack E. Morris provides professional legal services to clients throughout Louisiana. Engaged in civil litigation and counseling in the areas of appellate law,* insurance law, real estate and property law, construction law, business and commercial law, and intellectual property law, Mr. Morris represents a diverse clientele including large and small businesses as well as individuals. Mr. Morris has represented clients before state and federal courts at every level, including the Louisiana Supreme Court and United States Supreme Court, and also before various arbitration and mediation forums.

*Mr. Morris is Board Certified as an Appellate Practice Specialist by the Louisiana Board of Legal Specialization, and he currently serves as a Member of the Board's Appellate Practice Advisory Commission.

The rules of ethics governing the work of lawyers in state and federal appellate courts in Louisiana derive from the Louisiana Rules of Professional Conduct in general, and from select articles and rules in the Louisiana Code of Civil Procedure, the Louisiana Uniform Rules of the Courts of Appeal, the Federal Rules of Appellate Procedure, and the U.S. Fifth Circuit Rules. This article explores some of the ethical issues implicated by the application of these rules to the handling of appeals.

Congress enacted the Employee Retirement Income Security Act of 1974 ("ERISA") to correct two specific problems: the first problem concerned abuses of assets held in trust by employers for the benefit of employees; the second concerned inconsistent state laws which created administrative burdens on employers who choose to establish benefit plans for employees in more than one state. In an effort to assist courts in achieving ERISA's goals, this comment proposes an interpretation of ERISA's definition of "employee welfare benefit plan" under which an employee group health insurance plan should not be characterized as an ERISA plan unless to do so would promote ERISA's dual goals of protecting workers' benefits and encouraging the formation of employee beneift plans.

Wetlands regulations are an increasingly important issue for buyers and sellers contemplating the transfer of undeveloped acreage. A parcel of land declared to be a jurisdictional wetland cannot be developed without the approval of the Army Corps of Engineers or the Soil Conservation Service. This issue can create a conflict between a buyer and a seller; a buyer will want a determination of wetlands status before a sale. However, the seller will want to wait since a determination of wetland will affect the land's market value.
